General Rental Terms and Conditions — Apartment " Aurea"

1. Parties and Subject Matter
This contract governs the short-term holiday rental pursuant to applicable Italian law, concluded between:
LANDLORD: Carlo Di Silvestro, C.F. DSLCRL71S16C351G.
TENANT: The person requesting the booking, identified through the data provided at the time of the request.
The property exclusively subject to rental is the apartment known as "Aurea", located in Syracuse, Ortigia, Via Dione 71, identified by the following National Identification Code (CIN): IT089017C2EMXY4TXT.
2. Booking Confirmation
The availability request submitted through homeortigia.com constitutes a mere contractual proposal. The contract is concluded exclusively upon receipt by the Tenant of the written Booking Confirmation sent by the Landlord.
3. Rent and Payment Methods
The rental fee is determined based on the rates displayed on homeortigia.com at the time of booking.
- Advance online payment: The full rental fee is due at the time of booking via the online payment system integrated into homeortigia.com. The booking is confirmed only upon successful payment.
- Accepted payment methods: PayPal, credit/debit card (Visa, Mastercard, American Express), MyBank — all processed securely via the PayPal platform.
- City Tax: A city tax from the Municipality of Syracuse is added to the rental fee, to be paid in cash upon arrival, calculated according to the rates in force at the time of the stay.
- Receipt: Following payment, the Tenant automatically receives a confirmation email with a booking summary and PayPal transaction ID.
4. Right of Withdrawal and Cancellation
Exclusion of right of withdrawal: Pursuant to art. 59, paragraph 1, lett. l) of EU Directive 2011/83/EU, the 14-day right of withdrawal provided for distance contracts does not apply to accommodation service contracts for a specific date or period. The Tenant acknowledges this exclusion upon acceptance of these terms.
In case of cancellation, the following conditions apply:
- Free Cancellation: Cancellation is free of charge up to 7 days before the arrival date. In this case, the Landlord will refund the full amount paid via PayPal within 5-7 business days.
- Late Cancellation: For cancellations with less than 7 days notice before arrival, the Landlord retains 50% of the total rental fee paid as a penalty. The remaining 50% is refunded via PayPal within 5-7 business days.
- No-Show: In case of no-show without prior notice, the Landlord retains the full amount paid.
- Early Departure: In case of early release of the property before the agreed date, no refund of the rental fee already paid is provided.
To request cancellation, the Tenant must contact the Landlord by email at homeortigia@gmail.com stating name, stay dates and PayPal transaction ID received in the confirmation email.
5. Check-in, Check-out and Identification
- Hours: The property will be available from 3:00 PM on the day of arrival and must be vacated by 10:00 AM on the day of departure. Different arrangements must be agreed in advance.
- Self Check-in: Automated access via lockbox is available. Codes will be provided after document submission.
- Legal Obligations (TULPS): To comply with the obligation to report to Public Security (Alloggiati Web Portal), the Tenant undertakes to provide a copy of identity documents of all occupants before or upon arrival.
6. Security Deposit
The Tenant is the custodian of the property for the duration of the stay. The Landlord reserves the right to request a security deposit of €200.00 upon arrival as a guarantee for any damages.
This deposit (if paid) will be returned at check-out, after verifying the condition of the premises. In any case, the Tenant is civilly liable for any damage caused to the structure, furnishings and equipment.
7. House Rules
- No Smoking: Smoking is strictly prohibited inside the apartment.
- No Parties: Parties, events or admission of unregistered persons are prohibited.
- Pets: Pets are not allowed unless otherwise agreed in writing.
- Quiet Hours: Silence is required during rest hours (10:00 PM - 8:00 AM and 2:00 PM - 4:00 PM).
8. Limitation of Liability
The contract is a short-term holiday rental and does not include hotel-style personal services. The Landlord is not responsible for:
- Utility interruptions (water, electricity, gas, internet) attributable to force majeure or public network operators.
- Theft or loss of valuables left unattended inside the property.
9. Governing Law and Jurisdiction
This contract is governed by Italian law. For any dispute concerning the interpretation, execution or termination of the contract, the Court of Syracuse shall have exclusive jurisdiction.
